These Terms of Service form a binding agreement between you and SmartIO Bilişim Sistemleri San. ve Tic. Ltd. Şti., the operator of the Browsonic platform, and govern your access to and use of the Browsonic service.
Welcome to Browsonic. These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and SMARTIO BİLİŞİM SİSTEMLERİ SANAYİ VE TİCARET LİMİTED ŞİRKETİ ("SmartIO", "we", "us"), the operator of the Browsonic platform, governing your access to and use of the Browsonic service, including the website at browsonic.com, our dashboard, our software development kits and any associated services (collectively, the "Service").
By creating an account, clicking "I agree", installing our SDK or otherwise using the Service, you accept these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" refers to that entity.
1. The Service
Browsonic provides real-time JavaScript error and event monitoring tools for web and application developers. The Service captures runtime errors, unhandled rejections, network failures and related telemetry from your applications, stores them for retrieval and presents them through our dashboard and APIs.
We may update, modify or improve the Service from time to time. Material changes that reduce functionality you rely on will be communicated in advance where reasonably possible.
2. Accounts
To use the Service you must create an account and provide accurate, current and complete information. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us at browsonic-security@smartiobilisim.com without undue delay if you suspect unauthorised access.
Each account may host one or more tenants and may invite additional users (members) subject to plan limits. The account owner is responsible for all use by members and for billing.
3. Plans, Fees and Billing
Browsonic offers free and paid subscription plans. Plan inclusions, event volumes, retention windows and prices are described on the pricing page or in an order form executed with you.
Billing cycle
Paid plans are billed in advance on a recurring basis — monthly or annually, as selected at checkout. Subscriptions automatically renew at the end of each billing cycle unless cancelled at least one (1) day before the renewal date.
Payment processor
All payments are processed by our third-party payment processor. By providing payment information you authorise us and our processor to charge the applicable fees and any taxes to your selected payment method. We do not store full payment card numbers on our infrastructure.
Overages
If your usage exceeds the limits of your plan we will notify you and, depending on your plan, charge overage fees at the published rate or rate-limit your ingestion until the next cycle.
Taxes
Fees are exclusive of taxes. You are responsible for any sales, use, value-added or similar taxes associated with your purchase, except for taxes based on our net income.
Failed payments
If a payment fails we will retry the charge. If a payment is not collected within seven (7) days we may suspend access to paid features until the balance is cleared.
4. Refunds
Refund eligibility and procedure are described in our Refund Policy, which forms part of these Terms.
5. Free Trials and Free Plan
We may offer free trials of paid features. Unless we state otherwise, trials automatically convert to a paid subscription at the end of the trial period using the payment method you provided. You can cancel before conversion at any time.
Our free plan is provided "as is" and may be limited, suspended or discontinued at our discretion.
6. Acceptable Use
You agree not to, and not to permit any third party to:
- use the Service in violation of any applicable law or regulation;
- send to the Service any content, data or telemetry containing personal information beyond what is strictly necessary for error monitoring, special-category personal data, or payment card data;
- attempt to reverse-engineer, decompile or otherwise discover the source code of any non-open-source component of the Service;
- interfere with or disrupt the integrity or performance of the Service, including by sending unreasonable volumes of requests or by attempting to circumvent rate limits, authentication or quotas;
- use the Service to build a competing product;
- resell, sublicense or commercially exploit the Service except as expressly permitted.
We may suspend access immediately, with or without notice, if we reasonably believe your use violates these Terms or creates risk for us or other customers.
7. Customer Data
"Customer Data" means the event data, telemetry and other content you (or your end users via your applications) submit to the Service.
Ownership
As between you and us, you retain all right, title and interest in and to Customer Data. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, transmit and display Customer Data solely as necessary to provide the Service to you.
Responsibility
You are responsible for the lawfulness of Customer Data and for obtaining all necessary consents from your end users. Configure the SDK's redaction and sampling options to keep sensitive data out of payloads where appropriate.
Data processing
Our processing of personal data within Customer Data on your behalf is described in our Privacy Policy and, where required, our Data Processing Addendum (available from browsonic-privacy@smartiobilisim.com).
8. Intellectual Property
The Service, including all related software, documentation, designs, marks and content (other than Customer Data and Customer's marks), is owned by Browsonic or its licensors and is protected by intellectual property laws. We grant you a limited, non-transferable, non-exclusive right to access and use the Service during your subscription term.
Open-source components such as our SDK are licensed separately under their respective open-source licences (Apache 2.0 unless otherwise stated).
9. Confidentiality
Each party agrees to protect the other's confidential information with the same degree of care it uses for its own (and no less than reasonable care). Confidential information includes non-public technical and business information disclosed in connection with the Service. Customer Data is your confidential information.
10. Disclaimers
Except as expressly stated in these Terms, the Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fit for your specific operational needs.
11. Limitation of Liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunities, arising out of or related to these Terms.
Our aggregate liability arising out of or related to these Terms will not exceed the amounts paid by you to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (US$100), whichever is greater.
These limitations apply regardless of the legal theory of liability and even if a party has been advised of the possibility of such damages. They do not apply to fraud, wilful misconduct or to liabilities that cannot be limited under applicable law.
12. Indemnification
You will defend, indemnify and hold harmless Browsonic, its affiliates and personnel from and against any third-party claims, damages, losses and expenses (including reasonable legal fees) arising from (i) your use of the Service in breach of these Terms, (ii) Customer Data, or (iii) your violation of any law or third-party right.
13. Term and Termination
These Terms remain in effect for as long as you have an account.
You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the then-current billing cycle.
We may suspend or terminate your account immediately if (a) you materially breach these Terms and do not cure the breach within seven (7) days of notice, (b) your account is more than 30 days past due, or (c) we are required to do so by law.
On termination: your right to access the Service ends; we may delete Customer Data after a retention window described in the Privacy Policy; sections that by their nature should survive (including IP, confidentiality, disclaimers, liability, indemnification and governing law) will survive.
14. Modifications to these Terms
We may update these Terms from time to time. Material changes will be communicated by email to your account owner or by notice in the dashboard at least fifteen (15) days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules. The Adana Courts and Enforcement Offices of the Republic of Türkiye will have jurisdiction over any dispute arising out of or related to these Terms, except that either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information. Consumers retain any non-waivable rights granted by mandatory consumer protection law in their country of residence (including, for Turkish consumers, the jurisdiction of the local consumer arbitration committee or consumer court under Law No. 6502).
16. Miscellaneous
These Terms, together with the Privacy Policy, Refund Policy and any order form, constitute the entire agreement between you and Browsonic regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our prior written consent; we may assign in connection with a merger, acquisition or sale of assets.
